As indicated on
P. 39 of the Audit| this Next Step was “framed by the experiences and opinions of the review team.”

Response:

The District has redacted the names| identifiers and District email accounts of students and parents| as individually identifiable student information (5 ILCS 140/7.5 (r)) is exempt under FOIA 7(1)(a): Information specifically prohibited from disclosure by federal or State law or rules and regulations implementing federal or State law.


The District has redacted the names and personal email addresses of private citizens| as the public release of such information may constitute “private information” and “a clearly unwarranted invasion of personal privacy” 5 ILCS 140/7(1) (c); 5 ILCS 140/2(c-5) per FOIA Section 7(1)(b); see Chicago Alliance for Neighborhood Safety v. City of Chicago| 348 Ill. App. 3d 188| 209| 211 (1st Dist. 2004) (court upheld the redaction of private citizens’ names and identities| noting that “the core purpose of the FOIA is to expose what the government is doing| not what its private citizens are up to.”). Further the District’s redaction of the identities of private citizens pursuant to these exemptions is the subject of pending Requests for Review with the Illinois Attorney General’s office (e.g.| 2014 PAC 32722). In the absence of a ruling from the Attorney General| the District continues to redact this information consistent with the handling of past FOIA responses.

The District has withheld the preliminary draft minutes of the December 12 2019 Regular Action Meeting| January 9 2020 Committee of the Whole Meeting| and January 23 2020 Regular Action Meeting per FOIA section 7(1)(f).
